I am posting an obtained through a FOIA request that should continue to enlighten the public about County Attorney Cindy Nutter's own admission of her understanding of her duties. Carolyn,
I apologize that I missed your call. I am in a required Emergency Management Training in Midland for the rest of the week, but am checking messages after hours.
I understand your concerns regarding that above referenced lawsuit. I did meet with Allison in the County Attorney’s Office last week. We discussed the litigation. She understands that Ector County is not a party to the lawsuit, but instead it is the Ector County Bail Bond Board and you that are named. Considering this the statute governing Bail Bond Boards is quite clear that the County Attorney is both a sitting member of the Bail Bond Board and is ALSO the legal representative of the Board.
Ector County does not need to hire outside counsel because they are not a party. Allison and I both agree that the County Attorney must represent the Bail Bond Board. She did file an answer and if you remember back to when this all started last year, Cindy did appear in Judge McCoy’s Court on behalf of the Board. Allison did assure me that the County Attorney’s Office will be at the hearing on the 31st of August, you and I will also need to be present.
